Sale and purchase of real estate

Documentation and necessary information

  • Original ownership title of the sellers
  • National Identity Card of buyers and sellers. If they are companies, relevant powers of attorney or valid document proving the position of the representative
  • Certificate to prove the seller is up to date with payments of maintenance and service charges
  • Latest receipt of Real Estate Tax (I.B.I.)
  • Unique Property Reference Number of the property
  • Non resident foreigners need a Spanish N.I.E. (foreigner identification number) for the sale and purchase to be registered in the Register of Real Estate

Data of interest

  • Operation Costs. If there is no agreement on this matter and in compliance with current legislation, costs are shared as follows:
    • Seller: The deed (i.e. the authorized copy) and the Capital Gain (increase in the value of properties)
    • Buyer: The copies of the deed, the inscription costs in the Register of Real Estate and Taxes
  • In any sale contract, or Real Estate lien, it will have to be indicated whether the price was received before or at the time of drafting the deed, as well as the means of payment used and the amount paid through each means of payment. Regarding the time of payment, the notary public will indicate whether it took place before, the date or dates when it took place and the means of payment used on each of those dates.
    If the grantor refuses to identify all or part of the means of payment, the notary public will have to report this circumstance in the deed.
    In the deed, the notary public will have to bear witness of the cheques or documents that justify the means of payment used; those are shown by the grantors.
    If the grantor refuses to identify all or part of the means of payment used, the notary public will notify him/her that the information will be submitted to the Tax Office, and will report it in the deed.
    As long as proof of the means of payment has not been provided, the deed will not be registered in the Register of Real Estate.
  • Payment of the capital gain must take place within the following 30 days, with the simple copy delivered by the notary public and a photocopy of the National Identity Card, N.I.F. (tax identification number) or N.I.E. (foreigner identification number) of the person who has to pay. If it has been agreed that the buyer will pay the capital gain, a photocopy of the National Identity Card of the seller and a photocopy of the latest Real Estate Tax (I.B.I.) must be included.
