Documentation and necessary information

• National Identity Card of the person who requests the affidavit, who must be a descendant, ascendant or spouse of the deceased (only one person is required for the affidavit, although all the declared heirs will have to sign for the inheritance)
• Death certificate
• Certificate of last wishes
• Marital status certificate if the deceased was married
• Birth certificates of children
• Family record book
• National Identity Card or census certificate of the deceased to check his/her last address
• 2 witnesses who knew the deceased

Data of interest

• Competent Notary Public to proceed: the Notary Public of the decedent's last address in Spain
• Delay: 6 months following death
• Once the affidavit has been initiated, one must wait 20 days, after which the inheritance can be accepted.
